1. Description of Service
Pickly.us (“Pickly,” “we,” “us,” “our”) is an online vehicle marketplace and facilitation platform that helps buyers
purchase used vehicles remotely and helps sellers list vehicles to reach verified buyers.
We are not a traditional car lot. Depending on the transaction, Pickly may act as a broker, facilitator, or marketplace operator
and may not be the legal seller of the vehicle. The legal seller may be a private individual or a licensed dealer.
Transaction-specific terms, documents, and disclosures may be provided separately for each purchase.
Pickly services may include:
- displaying vehicle listings from private sellers and dealers,
- coordinating professional pre-purchase inspections,
- coordinating payment steps via bank transfer and/or referring buyers to financing partners,
- coordinating transport and delivery through logistics partners,
- providing documentation guidance and workflow support.
2. Eligibility and Registration Obligations
To use certain features of the Website, you may need to create an account. By using Pickly, you agree that you:
- are at least 18 years old and legally able to enter into a contract,
- will provide accurate, current, and complete information,
- will update your details if they change.
We may suspend or close accounts that provide false information, abuse the Service, or violate these Terms.
3. User Account, Password, and Security
You are responsible for keeping your login details (email, password, codes) secure and confidential. You agree to:
- not share your account,
- notify us immediately if you suspect unauthorized access,
- log out when using a shared/public device.
Pickly is not liable for losses caused by unauthorized use of your account due to your failure to safeguard credentials.
4. User Conduct
You agree to use Pickly only for lawful purposes and in a respectful manner. You agree not to:
- use the Website for illegal, fraudulent, or misleading activity,
- submit false information about identity, finances, or vehicle details,
- interfere with or disrupt the Website, servers, or networks,
- attempt to gain unauthorized access to accounts or systems,
- copy, scrape, or harvest data without written permission,
- harass, threaten, or abuse users, sellers, partners, or staff.
We may restrict or terminate access for violations.
5. Fees, Payments, and Credit Policy (Bank Transfer Only)
5.1 Bank Transfer Payments Only
Pickly accepts payments via bank transfer only for platform fees described below. We do not accept cash,
checks, crypto, or card payments through the Website. Payment instructions (beneficiary details, reference, and timing)
are provided during the transaction.
Payments are considered received only when cleared in the destination account.
5.2 Seller Fees
- Listing Fee (Seller): $49 — paid to publish a vehicle listing on Pickly.
- Success Fee (Seller): 2% of the vehicle sale price — paid by the seller only if the vehicle sells, due at closing.
5.3 Buyer Inspection Fee (No Deposit)
Buyers start the process by paying a $199 inspection fee via bank transfer. No deposit is required.
The inspection fee is used to coordinate and pay for inspection services and related administration.
5.4 Inspection Fee Credit (Fail / Major Issues)
If the inspection result is classified as “Fail / Major Issues”, the $199 inspection fee is credited 100%
toward the inspection of another vehicle listed on Pickly.
This credit is not refundable in cash.
Credit validity: 90 days from the inspection report date (unless stated otherwise in a transaction email).
5.5 Free Delivery Within the United States
Pickly offers free standard vehicle delivery within the continental United States for completed transactions.
Delivery is scheduled after closing and full payment confirmation.
Free delivery applies to standard transport routes within the continental U.S.
Additional charges may apply for:
- Alaska, Hawaii, or U.S. territories,
- expedited shipping requests,
- remote or restricted-access locations,
- special vehicle transport requirements (e.g., oversized, non-running vehicles).
Pickly may coordinate logistics through third-party transport providers and does not operate as the carrier
unless explicitly stated in writing.
6. Inspections, Reports, and Vehicle Condition
Inspections are performed by third-party inspectors or service providers. Inspection reports are informational and based on
visible/accessible conditions at the time of inspection.
Pickly does not guarantee:
- the future mechanical performance of the vehicle,
- that all defects will be found,
- that an inspection is equivalent to a manufacturer certification.
Buyers should review the report carefully and ask questions before approving.
7. Financing (If Available)
Financing options may be offered through third-party lenders or partners, subject to approval, eligibility, and state availability.
Pickly does not guarantee financing approval and is not responsible for lender decisions, rates, or terms.
Where financing is offered, buyers may be required to make a minimum down payment (e.g., 30%) depending on the lender and transaction.
8. Closing, Title, Taxes, Registration, and Documentation
8.1 Closing and Final Payment
The buyer completes final payment only after reviewing and approving the inspection report and completing required documents.
Pickly may facilitate workflow steps but may not be the legal seller.
8.2 Title Transfer and Documentation
Title transfer requirements vary by state and seller type (private vs dealer). The legal seller is responsible for providing the title
and required disclosures as applicable. Buyers are responsible for verifying title status and completing registration requirements in their state.
8.3 Taxes and Registration
Buyers are responsible for applicable taxes, registration fees, and local compliance unless stated otherwise in writing.
9. Test-Drive Guarantee After Delivery (General Policy)
Pickly may offer a limited test-drive guarantee after delivery (for example, 7 days / 250 miles) to confirm the vehicle generally
matches the listing and inspection report.
This guarantee does not cover:
- normal wear and tear,
- issues disclosed in the listing or inspection report,
- damage caused after delivery,
- misuse, accidents, modifications, or neglect.
Exact guarantee terms, eligibility, and return procedures (if offered) may vary by vehicle and will be provided in writing for the specific transaction.
10. Cancellations, Refunds, and Disputes
- The $199 inspection fee is not refundable in cash. If the inspection result is Fail / Major Issues, it becomes a 100% credit toward another inspection (see Section 5.4).
- Delivery charges and third-party costs may be non-refundable once services are booked.
- Disputes between buyer and seller may require direct resolution between the parties, unless Pickly explicitly agrees in writing to assist as a mediator.
11. No Warranty; Disclaimer
Unless stated otherwise in writing, vehicles are sold as-is, where-is by the legal seller. Pickly makes no warranties, express or implied,
including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
12. Limitation of Liability
To the maximum extent permitted by law, Pickly shall not be liable for indirect, incidental, special, consequential, or punitive damages,
including loss of profits, data, or goodwill.
Pickly’ total liability for any claim related to the Service shall not exceed the total fees paid to Pickly by you in the
30 days prior to the event giving rise to the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless Pickly and its officers, directors, employees, and partners from any claims, damages, liabilities,
and expenses arising from your misuse of the Service, violation of these Terms, your content/listings, or violation of any law or third-party rights.
14. Intellectual Property
All content on Pickly (text, branding, design, logos, software, and layout) is owned by or licensed to Pickly and is protected by intellectual property laws.
You may not copy, reproduce, modify, distribute, or create derivative works without written permission.
15. Termination
We may suspend or terminate your access to the Service at any time for violations of these Terms or suspected fraud, without notice where permitted by law.
16. Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date will reflect changes. Continued use of the Website after changes constitutes acceptance
of the updated Terms.
17. Governing Law
These Terms are governed by the laws of the United States and the State of Florida, without regard to conflict-of-law principles.
